Terms of Service

By signing up for or using WebContact, you represent that you are at least 18 years of age, legally capable of entering into binding agreements, and that you agree to these Terms and our Privacy Policy. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

WebContact provides a Form Backend as a Service (FBaaS) platform that enables developers and agencies to:

• Connect website contact forms to a secure backend API
• Store and manage form submissions in a unified dashboard
• Configure spam protection, webhook routing, and CRM integrations
• Manage multiple client projects and API keys under one account

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable prior notice.

You must create an account using your Google account. You are responsible for:

• Maintaining the confidentiality of your API keys and access tokens
• All activities that occur under your account
• Notifying us immediately at webcontactsupport@vrtex.in if you suspect unauthorized access

API tokens are secrets. Do not embed live API tokens directly in public-facing client-side code. Use server-side environments or environment variables.

You agree to use WebContact only for lawful purposes. You must NOT:

• Use the Service to collect personal data without obtaining proper consent from individuals
• Submit or store data in violation of any applicable privacy law, including the DPDP Act, 2023
• Attempt to reverse engineer, compromise, or gain unauthorized access to the Service infrastructure
• Use the Service to collect or store sensitive personal data (Aadhaar numbers, financial account details, health data) without appropriate safeguards
• Use the Service to facilitate spam, phishing, or any form of deception
• Resell or sublicense API access without our written permission
• Use automated tools to scrape or extract data at volumes exceeding your subscribed plan limits

Violation of this policy may result in immediate suspension or termination of your account.

As a customer using WebContact, you are the Data Fiduciary for the form submission data you collect through third-party websites. You are responsible for:

• Obtaining valid consent from your end-users before collecting their personal data
• Displaying a clear Privacy Policy on your website that discloses the use of WebContact
• Complying with the DPDP Act, 2023 and any other applicable data protection laws
• Responding to Data Principal rights requests from individuals who submitted data through your forms

WebContact acts as a Data Processor on your behalf. We will process submission data only as directed by you and in accordance with our Privacy Policy and Data Processing Agreement.

WebContact offers the following plan tiers. Billing is monthly and in advance.

Exceeding your plan's submission limit will result in a temporary pause of new submissions until the next billing cycle or a plan upgrade. You will receive a notification when you reach 80% of your limit.

All content, software, and technology comprising the WebContact platform are owned by or licensed to WebContact and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our written consent.

You retain full ownership of the form submission data collected through your account. By using the Service, you grant WebContact a limited license to store and process this data solely for the purpose of providing the Service to you.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WEBCONTACT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

While we target 99.99% uptime, we do not guarantee uninterrupted service. We are not responsible for data loss due to factors outside our control, including third-party infrastructure failures.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW, WEBCONTACT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA.

Our total aggregate liability to you for any claims arising from your use of the Service shall not exceed the amount you paid to WebContact in the three (3) months immediately preceding the claim.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

We encourage resolution of disputes through good-faith negotiation before initiating formal proceedings. Contact us at webcontactsupport@vrtex.in to initiate a dispute resolution discussion.

You may terminate your account at any time by deleting it from the dashboard settings. We will delete your data in accordance with our Privacy Policy.

We reserve the right to suspend or terminate accounts that violate these Terms. We will provide reasonable notice before termination unless the violation poses an immediate security or legal risk.

We may modify these Terms at any time. Material changes will be communicated via email and a prominent dashboard notification at least 14 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
